Are accused by the Grand Jury of the County of Apache, Territory of Arizona, by this indictment of the crime of Grand larceny as follows: The said GEORGE WEST, GEORGE POWELL, WILLIAM EVANS and SAMUEL SPRAGUE, on or about the 27th day of January in the year of 1887, at the County of Apache, Territory of Arizona, and before the finding of this indictment, did, unlawfully and feloniously, steal, take, carry and lead away one bay stallion, a further description of said stallion being to the Jury unknown, the said stallion, then and there, being of the property of Spencer Wiltbank, and being, then and there, of the value of $100.00, contrary to the form of the statute of the Territory of Arizona, in such cases made and provided and against the peace and dignity of the same.

Harris Baldwin, District Attorney of Apache County, Territory of Arizona.   Names of the witnesses examined before the grand Jury upon the finding of this indictment, Elisha Averett, Mary J. Brighton, Willie Johnson, J.V. Brighton, P.H. Snow, W.S. Atchison and Peter Brogden. Feb. 4th 1887.   A true bill.

Are accused by the Grand Jury of the County of Apache, Territory of Arizona, by this indictment of the crime of grand Larceny, as follows: That the said GEORGE WEST, GEORGE POWELL, WILLIAM EVANS and SAMUEL SPRAGUE on or about the 27th day of January 1887, at the County of Apache, Territory of Arizona, and before the finding of this indictment, did, unlawfully, feloniously, steal, take, carry and drive away one bay stallion and one sorrel mare, the said stallion and mare being the property of WM. Chistoferson, the value of said stallion being $100.00 the mare being $100.00, contrary to the form of the statute of the Territory of Arizona, in such cases made and and provided, and against the peace and dignity of the same. Names of witnesses on finding of this indictment, Elisha Averett, Mary J. Brighton, Willie Johnson, J.V. Brighton, P.H. Snow, W.S. Atchison and Peter Brogden. George West.

Complaint, under oath, filed in this office by Alex Dewitt and Joseph Thayne accusing the above named Defendants of the crime of concealing stolen property, knowing it to be stolen at the time they received it.   Said property being two or more horses, and said complaint's prays that a warrant be issued for their arrest and that they be delt with according to law.   Warrant was issued for their arrest on same day complaint was filed, Feb. 13, 1887, and placed in the hands of P.H. Snow, Deputy Sheriff, who arrested the above named Defendants and brought them into Court the same day, above written.   The complaint was read to them to which they pleaded "Not Guilty" and asked that six subponeas be issued for that number of witnesses to testify in their behalf.   The Court then adjourned the trial until Feb. 17, 1887.   After requiring said Defendants to give bonds in the sum of $500 each, which bonds were given.    February 17, 10:00 A.M.   This case came up regularly for trial.   The Defendants appearing in person and by Counsel, Judge Wm.M. Rudd, Counsel for the Defence, and the Hon. Harris Baldwin, District Attorney, for the Territory.   After a brief hearing, the Attorney for the prosecution asked that the case be dismissed.   The Defendants were then released from custody.

Complaint under oath, filed in this office, this 14th day of Feb. 1887, by Elisha Averett and Wm. W. Eagar, acusing the above named Defendants, Williams and Evans, of the crime of Grand Larceny and the said Defendants, West, Brighton and Powell of being accessories thereto, namely the stealing of two horses, the property of Penn Wiltbank of said County, and prays that warrants be issued for their arrest.   Warrant issued same day and placed in hands of P.H. Snow, Deputy Sheriff.   The officer brought Defendants, Geo. West and J.V. Brighton. (The others he did not find) The parties asked for time to get Counsel which was, upon filing a bond each in the sum of $500.00 allowed for their appearance before this Court on Feb. 17, 1887.   Each gave separate bonds.   Feb. 17, 1887, this case came up for trial, whereby, request of Dist. Attey. Harris Baldwin, the case was dismissed.
