IN THE DISTRICT COURT OF THE THIRD JUDICIAL DISTRICT COUNTY OF APACHE. AT THE FEBRUARY TERM A.D. EIGHTEEN HUNDRED AND EIGHTY FOUR
The said Bigg Dave and Cubb Langtry
accused by the Grand Jury of the County of Apache, Territory of Arizona by this indictment, found this 5th day of February, A.D. one thousand eight hundred and eighty four of the crime of robbery committed as follows:

The said Bigg Dave and Cubb Langtry on or about the 20th day of October, A.D. eighteen hundred and eighty three at the County of Apache and Territory of Arizona.

The said Bigg Dave and Cubb Langtry then and there being, did unlawfully, violently and feloniously in and upon the bodies of Julius Becker and Gustave Becker, then and there being in the place of the Territory of Arizona, make an assault, and with two certain deadly weapons, to wit: Two pistols commonly called six-shooters, which said two pistols, and each of them were then and there loaded and charged with gunpowder and leaden bullets, and one of which said pistols the said Bigg Dave then and there in his hand held and had, and the other of which said pistols the said Cubb Langtry then and there held and had in his hand, did them the said Julius Becker and the said Gustave Becker in danger and fear of their lives then and there unlawfully, feloniously and violently fret, and did then and there from the persons of them the said Julius Becker and Gustave Becker and against the will and without the consent of them the said Julius Becker and the said Gustave Becker or either of them, certain valuable things, to wit: Two hundred dollars in paper currency, gold and silver coin, good and lawful money of the United States, a further and more definite description of which said paper currency, gold and silver coin and money is to the Grand Jury unknown by means of said fear and intimitation and by force and intimidation unlawfully, feloniously and violently rob, take, steal and carry away.

August 4, 1884
The Court ordered the Defendant be brought into Court for arraignment.  The Defendant came into Court with his Attorney, Harris Baldwin.  The Clerk read the Indictment and copy given to Defendants Council.  The Defendant was then asked if the name by which he was indicted was his true name, and he asnwered that it was not.  He was then asked to declare the same, and he stated that his name was Charles Kingsley.  The Court ordered that he be proceeded against by his true name referring also to the name by which he was indicted.  The Court ordered that the Defendant have the usual time to pled.  The prisoner was then remanded.

The Court orders that the Defendant be brought into Court to plead to the Indictment.  The Defendant pleads that he is not guilty, as charged in said Indictment.  Court set for Friday.  The Defendant came into Court with his attorney, Harris Baldwin Esq.

This cause coming on regularly to be tried pursuant to the order of the Court, heretofore made Wm. M. Rudd and C. L. Gutterson appearing on behalf of the Government and Harris Baldwin Esq. on behalf of the Defendant.  Harris Baldwin Esq. Attorney for the Defendant moved the Court for a continuance of said cause on the ground that two of the material witnesses on the part of the Defendant could not be found.  C. L. Gutterson Esq. Assistant District Attorney objected, thereto.  The motion for a continuance was by the Court denied.  The Defendant with his Attorney being present in Court. The Court ordered the Jury drawn.  Before completing, the Panel, the Jury being exhausted, the Court orders that a special venue issue for twenty five good and lawful men to be summoned from the body of the County and not from the by-standers to be and appear before the Court forthwith.  Venue issued and the Sheriff makes due returns thereon.  Whereupon the following named persons were duly empanelled to try the case to wit: Wm. Willson, E. L. Taylor, E. D. Johnson, J. B. Patterson, A. Nicol, W. Farr, W. Gibbons, Henry Knowles, W. H. James, John Eaton. W. W. Pace.  With the usual admonition to the Jury, the Court took a recess until 2 o'clock P.M.  The Roll of the Jury was called and all responded to their names.  Whereupon Dionicio Baca, Gustave Becker, Julius Becker and Ebin Stanley were duly sworn as witnesses on the part of the Government.  On motion of Harris Baldwin Esq. witnesses were put under the Rule.  Dionicio Baca, Gustave Becker, Julius Becker, Ebin Stanley, then testified on the part of the Government.  The Government then rested.  The Defendant was sworn in his own behalf.  By consent of the Government and Defendant the case was submitted without arguement.  Both Parties waived writted instructions.  After the instructions of the Court, the Jury under the charge of a sworn Officer, retired to consider of their verdict.

INDICTMENT FOR ROBBERY

August 8, 1884
The Jury came into Court, the Roll being called. They all responded to their names. The Defendant being present. The Court then asked, "Gentlemen of the Jury, have you agreed upon a verdict?" To which they responded that they had. They were then asked to declare the same. Whereupon, they declared the following verdict to wit:
In the Third Judicial District of the Territory of Arizona in and for the County of Apache and the Territory aforesaid."We, the Jury, find the Defendant guilty as indicted."

Which verdict being recorded and read, they were asked, "Gentlemen of the Jury, is that your verdict, so say you all?"  To which they responded, "We do."  Upon motion of Harris Baldwin Esq. Attorney for the Defendant, the Jury was ordered polled, and each of said Jurors answered that it was their verdict.  The prisoner was then remanded to the custody of the Sheriff.  Harris Baldwin, Attorney for the Defendant, moved the Court for a new trial of said cause.

CONVICTED OF ROBBERY

August 14, 1884
The District Attorney, with the Defendant and his Council, came into Court.  The Defendant was duly informed by the Court of the nature of the charge against him for the crime of robbery, committed on the twentith day of October in the year of our Lord, One Thousand Eight Hundred and Eighty Three, of his indictment, arraignment and plea of not guilty, of the offense charged in the indictment, of his trial, and the verdict of the Jury on the eighth day of August A.D. 1884, guilty as charged in the indictment.  And the Defendant was then asked if he had any legal cause to show-why judgement and sentence should not be prononced against him.  To which he replied that he had none.  And no sufficient cause appearing or being shown to the Court, thereupon, the Court rendered its judgement and sentence as follows: That whereas the said Charles Kingsley, alias Cubb Langtry, having been duly convicted in this Court of the crime of robbery; It is therefore ordered, adjudged and decreed that the said Charles Kingsley, alais Cubb Langtry, be punished therefore as follows: That he be imprisoned and confined in the Territorial Prison at Yuma, in said Territory of Arizona, for the term and period of twelve years. The Defendant was then remanded to the custody of the Sheriff of the said County of Apache, to be, by him, delivered into the custody or custodians of said Territorial Prison at said Yuma in said Territory of Arizona.

Territory of Arizona to J. A. Baker alias Dock Baker, Jeff Schweikofer, Henry Porter, Mary Porter, William Jones, Sunn Pipkins: WE COMMAND YOU to appear before the District Court of the Third Judicial District, Territory of Arizona, County of Apache, at the Court House in the town of St. Johns, in said County and Territory, on the 5th day of August 1884, at 9 o'clock A.M., as a witness in a criminal action prosecuted by the Territory of Arizona against Cubb Langtry alias Chas. Kingsley.
